Probate
Probate is the process for transferring the property of a loved one after death. Many people are afraid of probate because they have heard horror stories about years and years of court battles. Most probate is not like that. It is a fairly simple and straight forward process. It establishes a personal representative and gives them the authority to pay the bills of the estate, collect the property and distribute it to the heirs.
Will or Last Will and Testament
A Will, also known as a Last Will and Testament, is a document which your attorney creates for you. The Will contains all the legal language required to show that you were "of sound mind and body". In addition, it states who your heirs are and how you want you property divided. If you die without a Will, that is called, "dying intestate". Your property may be divided differently that you want if you do not have a Will.
Trusts
Trusts are legal documents created by your attorney. They are many different types of Trust but in general, Trusts are created to protect your property and gives you control of how and when those assets will be distributed to your beneficiaries.
